These terms apply to businesses that subscribe to Receptly, the AI receptionist service operated by Agentive Group Co Pty Ltd (ACN 695 269 222, ABN 54 695 269 222) (“we”, “us”). By subscribing to or using the service you agree to them. If you are a caller rather than a client, our privacy policy and call recording disclosure are the documents that apply to you.
1. What the service is
Receptly answers phone calls diverted to it from your business number, asks callers the questions you have told us matter, books jobs into your calendar or job software where connected, and sends you a summary of each call. It is a managed service: we set it up, monitor it and tune it. You don’t configure anything unless you want to.
Receptly is a receptionist, not an emergency service. It is not suitable for calls where a delayed or mistaken response could endanger someone. Callers in an emergency are directed to call 000.
2. Fees
- Free week. Every plan starts with 7 days free, counted from the day your receptionist starts answering your calls, not the day you sign up. We take your card at sign-up and charge nothing until those 7 days are up. Cancel before then and you pay nothing, including the setup fee. You will not be charged before your receptionist is live.
- Setup fee. A one-off setup fee applies to monthly plans. It covers the discovery call, configuration, testing and the first month of monitoring and tuning, and is charged with your first plan fee at the end of your free week. The setup fee is waived on yearly plans. It is not refunded once charged.
- Plan fee. Billed in advance from the end of your free week, then on the same day each month, or yearly at the yearly rate. It covers answering, bookings, summaries and support.
- Minutes and overage. Each plan includes a number of call minutes per month. Minutes beyond that are charged at the per-minute rate shown for your plan and billed with the following month. If you exceed your included minutes in two consecutive months we will tell you and recommend a plan change before any further overage is billed.
- Fees are in Australian dollars and exclude GST unless stated.
- Cancelling a monthly plan. Tell us before your next billing date and the service stops at the end of the period you’ve paid for. Monthly fees are not refunded for part months.
- Cancelling a yearly plan. Yearly plans can be cancelled at any time. The yearly rate and the free setup are a discount for staying the twelve months, so if you leave early we charge you what a monthly client would have paid: the monthly plan fee for each month you used, plus the setup fee that was waived on your plan. Anything you have paid above that is refunded within 14 days of the cancellation taking effect. If the sum comes out in our favour we will not chase you for the difference.
- Coming back. When you leave we keep your setup (script, service areas and rules) for 90 days. Come back inside that and there is no new setup fee.
- Nothing in this section affects rights you have under the Australian Consumer Law that cannot be excluded, including your right to a refund where there has been a major failure with the service.
- We may change plan fees with 30 days’ written notice. If you don’t accept the change, you can cancel before it takes effect.
3. What we need from you
- Accurate information about your business, services, service areas, hours and how you want jobs handled. The receptionist can only be as right as what you tell us.
- Diversion of your number to the receptionist on the terms we agree, and any credentials needed for calendar or job-software integrations. You confirm you are authorised to give us that access.
- Prompt notice when something changes: new services, new areas, holidays, a new staff member who should get summaries.
- Compliance with the law in how you use the service, including telling callers about recording where your state requires it (see section 5).
4. Acceptable use
You may not use Receptly to make or receive calls that are unlawful, deceptive or abusive; to collect information you have no lawful basis to collect; to impersonate another business; or in a way that interferes with the service for other clients. We may suspend the service immediately if we reasonably believe this section is being breached, and we will tell you why.
5. Call recording
Calls answered by Receptly are recorded and transcribed so that we can send you accurate summaries and improve the service. The receptionist tells every caller at the start of the call that they are speaking to an automated receptionist and that the call is recorded. Recording laws vary by state; in some states all parties must consent. We provide the announcement; you are responsible for confirming the arrangement is lawful for your business and location, and for any additional notices your industry requires.
6. Your data
You own the content of your calls, your bookings and your business information. You grant us a licence to store, process and disclose that information as needed to provide the service and as described in our privacy policy. We may use de-identified, aggregated data to improve the service. When your account closes we delete call recordings and transcripts within 30 days unless the law requires us to keep them.
7. Service levels
We aim for the receptionist to answer every diverted call, around the clock. We depend on telephone carriers, cloud platforms and AI providers we don’t control, so we can’t promise it will never miss a call or never make a mistake. If the service is unavailable for more than 24 continuous hours for reasons within our control, we’ll credit you the monthly fee for the days affected. That credit is your sole remedy for downtime.
8. Liability
Nothing in these terms excludes rights you have under the Australian Consumer Law that can’t be excluded. Otherwise, to the extent the law allows, our total liability to you for anything arising from the service in any 12-month period is limited to the fees you paid us in the three months before the claim, and neither of us is liable to the other for lost profits, lost jobs, or indirect or consequential loss. You are responsible for what you do with the information the receptionist passes to you.
9. Ending the agreement
You can cancel any month under section 2. We can end the service with 30 days’ notice, or immediately if you breach section 4 or don’t pay. On termination we stop answering your calls, remove any diversion we control, and hand back your data on request.
10. General
These terms are governed by the law of New South Wales, Australia. We may update them with 30 days’ notice by email; continuing to use the service after that date means you accept the new terms. Questions about these terms go to privacy@receptlyai.com.au.
